These terms and conditions outline the rules and regulations for the use of Giulia Variara Ecologist and Nature Guide’s Website, located at www.giuliavariara.com.
By accessing this website and by booking any of our excursions/events you agree to the terms and conditions below. We assume you accept these terms and conditions. Do not continue to use Giulia Variara Ecology | Outdoor activities | Environmental Education if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them. Except where expressly stated, these conditions only apply to tour arrangements booked by the client with the Company and which the Company agrees to make, provide or perform (as applicable) as part of their contract with the client. All references in these conditions to “activity”, “excursion”, “event”, “booking”, “contract” or “arrangements” mean such tour arrangements unless otherwise stated.
Excursions and other activities agreement
The agreement is between the Company and the client (“the client” and “you” in these conditions), being any person travelling or intending to travel on a tour operated by the Company including any person who is added or substituted after booking. We both agree that the Dutch law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (except as set out below). We both also agree that any dispute, claim or other matter of any description (and whether or not involving any personal injury) which arises between us must be dealt with by the Dutch Court only. No employee of the Company other than a director has authority to vary or omit any of these terms. No promise of a discount or refund will be binding on us unless confirmed by us in writing.
Secure a booking
To secure a booking, the Company must receive payment of the total excursion or activity price. All clients (including anyone who is added or substituted at a later date), whether booking in person, by telephone, via our website, by e-mail, Meetup or by any other means, will be deemed to have agreed to the following four conditions:
a) they have read and accepted our booking conditions;
b) they appreciate and accept the risks involved in nature/adventure excursions or activity;
c) they do not suffer from any pre-existing medical condition or disability which may prevent them from actively participating in the tour – if any person suffers from any medical condition or disability which will or may affect their tour arrangements, please contact us before making your booking so that we can advise;
d) the person making the booking warrants that he/she is at least 18 years old and has full authority to enter into a contract on the basis of these conditions on behalf of all persons named on the booking and confirms that all such persons are fully aware of and accept these conditions.
A booking is accepted and becomes definite only from the date when the Company issues a confirmation invoice to the client who makes the booking or their authorised agent. It is at this point that a contract between the Company and the client comes into existence.
For bookings made via our website, any acknowledgement of your booking request we send to you in the meantime is not a confirmation of your booking. Before your booking is confirmed and a contract comes into force, the Company reserves the right to increase or decrease holiday prices. The Company or their agents reserve the right to decline any booking at their discretion.
If you book via our website, we will communicate with you by e-mail. You must accordingly check your e-mails on a regular basis. We may also contact you by telephone and/or post if we cannot, for whatever reason, contact you by e-mail. Certain documents may need to be sent by post. References in these conditions to “send” and “in writing” or similar include communication by e-mail. You should contact us by e-mail if you need to do so for any of the reasons mentioned in these booking conditions. All e-mails should be sent to info@giuliavariara.com
Payment for the activity
The balance of all monies due, including any surcharges applicable at that time, must be received by us not later than 7 days prior to the start of the event. This will be shown on the confirmation invoice. Reminders are not sent. If we do not receive all payments due (including any surcharge where applicable) in full and on time, we are entitled to assume that you wish to cancel your booking.
If you change the booking
Should you wish to make any changes to your confirmed booking, you must notify us in writing as soon as possible. Whilst we will endeavor to assist, we cannot guarantee we will be able to meet any such requests. Changes are subject to availability. You can request a credit voucher for the amount paid in respect of any cancelled booking. This must be redeemed within 3 months of issue against a new booking. The voucher is not transferable, can only be redeemed against one booking and cannot be exchanged for cash. No refund or further credit voucher will be provided if the cost of the new booking is less than the value of the credit voucher.
If a client is unable to participate, in circumstances which the Company considers reasonable, the booking or that client’s place on the booking may be transferred to another suitable person (introduced by you).
Cancellation
In case you do need to cancel your activity, please let us know as soon as possible. Payments are non-refundable, but you are welcome to transfer your spot to someone else. Please let us know if you are planning to do this so that we know who to expect on the activities. If you are unable to transfer your spot to someone else you will lose your money.
If Giulia Variara Ecology | Outdoor activities | Environmental Education has to cancel the event then all customers are entitled to a full refund.
Activity participation and client responsibility
All participants (members and their guests) on any of Giulia Variara Ecology | Outdoor activities | Environmental Education are personally responsible for their fitness, safety and welfare and must be equipped accordingly. Payments for the activities are non-refundable and full payment is taken on booking.
Clients must provide any information we ask for in good time and are responsible for providing accurate information to the Company. This includes the customer information form that all clients are asked to complete prior to their adventure. Giulia Variara Ecology | Outdoor activities | Environmental Education will not accept responsibility for any problems or additional costs that arise from inaccurate information provided by the Client. Clients agree to accept the authority and decisions of the Company’s employees, tour leaders, fixers, agents and guides whilst on tour with the Company. If in the opinion of any such person(s) or any other person in a position of authority, the health, level of fitness or conduct of a client at any time before or during a tour is endangering or appears likely to endanger the health or wellbeing of the client or any third party (including any other clients of the Company) or the safe, comfortable or happy progress of the tour, the client may be excluded from all or part of the tour without refund or recompense. Where a client is excluded, the Company will have no further responsibility towards them (including any return travel arrangements) and we will not meet any expenses or costs incurred as a result of the exclusion. In the case of ill health, the Company may make such arrangements as it sees fit and recover the costs thereof from the client. If a client commits an illegal act (including, for example, causing any damage) the client may be excluded from the tour and the Company shall cease to have responsibility to/for them as above. No refund will be given for any unused services. When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made direct to the accommodation owner or manager or other supplier or to us as soon as possible. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against us and all costs incurred by us (including our own and the other party’s full legal costs) as a result of your actions. You should ensure you have appropriate travel insurance to protect you if this situation arises. Any clients who have taken part in racist / offensive / abusive or any other form of discriminatory behavior to clients, guides, or any other people associated with Giulia Variara Ecology | Outdoor activities | Environmental Education activity will be excluded from the tour and will receive a zero refund for any missed services or accommodation.
If a client deviates from the itinerary confirmed by Giulia Variara Ecology | Outdoor activities | Environmental Education, we will hold no responsibility financial or moral for that client. The client will not receive a refund on any missed services or accommodation during the remainder of the tour.
Special requests and medical conditions
If you have any special request, you must advise us at the time of booking. Although we will endeavor to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. For your own protection, you should obtain confirmation in writing that a special request will be complied (where it is possible to give this) where it is important to you.
If you have any medical condition or disability which may affect your active participation in your tour or the tour arrangements of any other person or have any special requirements as a result of any medical condition or disability (including any which affect the booking process), please tell us before you confirm your booking so that we can assist you in considering the suitability of the proposed tour and/or making the booking. In any event, you must give us full details at the time of booking and whenever any change in the condition or disability occurs. You must also promptly advise us if any medical condition or disability which may affect your active participation in your tour or the tour arrangements of any other person develops after your booking has been confirmed.
By booking you acknowledge that you understand the potential risks and hazards that can be involved in activities of this kind. Such risks may increase the risk of injury or illness, loss or damage to property, discomfort and inconvenience.
